Overview of Dade County domestic violence procedure: You must first
obtain a temporary injunction, which is an order signed by a judge. Dade
county has 4 domestic violence intake offices. At the time of filing for
the temporary injunction, there will be domestic violence counselors to
answer your questions.The order requires that the abuser stay away from
you and your family and your job. This order can give you possession of
your home, award you child custody and child support and you can begin
divorce proceedings. You may also file for divorce separately and the
domestic violence case and the divorce will be joined. If you have
no money, the filing fee will be waived at that time or the judge may
decide that the abuser must pay the fee. In case you or your
children are in danger of being further bodily harmed or stalked, the
judge will allow you and your children to stay at a safe house at an
address unknown to the abuser. This person will be required to give up
any firearms or weapons in his possession, give up keys, gate openers
and security cards, and the abuser will be arrested in the event of
violation of the judge’s order. A hearing will be set for entry of a
permanent injunction which will last as long as the judge determines,
but a year at the least. The abuser must attend an anger management
and batterer’s intervention program, and the victim and children can
receive counseling at no cost.
